The agreement between you and Underweather.

Using Underweather

By installing or using Underweather you agree to these terms. If you do not agree, please do not use it.

You need to be 18 or over to hold a subscription. You may keep track of a child's health, or the health of someone you care for, using the profiles inside the app — you remain responsible for what you record about them and for having the right to record it.

What Underweather is not

• It is not a medical opinion. The words it puts to your day are drawn from what you logged. They are descriptions, not conclusions.
• It is not monitored. Nobody is watching what you write. It cannot call anyone for you and it will not raise an alarm.
• It is not an emergency service. In an emergency, call your local emergency number.
• It is not a reason to ignore your instincts. If you think something is wrong, act on that, whatever the app says.

Your record is yours, and it is your responsibility

What you log is stored on your device, not with us. That means you own it outright — and it also means that without a backup, we cannot recover it if you lose the device or delete the app.

Backup is the answer to that, and it is worth turning on. In Settings you can switch on a secure copy that we keep for you. It is off until you choose it. Once it is on, a copy of your record is held so it can be restored to a new phone — you sign in with a one-time link sent to your email, and your record comes back.

• Backup is included in your subscription. There is nothing extra to pay for it.
• It is yours to switch off. You can turn it off, and ask us to delete the copy, at any time — see the Privacy Policy for how we handle it.
• We do not read it or share it. It exists to be given back to you.
• It is a safeguard, not a guarantee. We take care of it, but no backup anywhere is infallible, and we cannot promise a copy will always be recoverable. If a record matters to you enormously, keep your own export as well.

If you choose not to turn backup on, that is a perfectly reasonable choice — and it means the record lives and dies with the device. Please make your own copy instead.

The subscription

• Underweather is $3.99 a week, $14.99 a month, or $149.99 a year. A subscription covers up to four people; if you need more, there is a six-person option priced as its own plan. Prices are in Australian dollars and include GST where it applies. The price shown by the store when you subscribe is the one that applies.
• It renews automatically at the same price until you cancel, and your account is charged within 24 hours of the end of the current period.
• Cancel any time through the App Store or Google Play, at least 24 hours before the period ends. Cancelling stops the next charge; it does not shorten the period you have already paid for.
• Payment is taken by Apple or Google, depending on where you subscribed, and managing or cancelling happens in that account’s own settings — not here.
• If you cancel or let it lapse, your record stays on your device.

Nothing in these terms limits your rights under the Australian Consumer Law, including your right to a remedy if a service is not supplied with due care and skill. Refunds are handled by the store you bought through — Apple or Google — under that store’s own policies.

Changes to the price

If we change the price of a plan, we will tell you before it applies to you, and you will have the chance to cancel first.

Availability

We work to keep Underweather running, but we do not promise it will always be available or error-free. Parts of it — the read, and talking things through — depend on a service outside our control and may be unavailable at times. Everything else — logging, your record, your reminders and your summaries — keeps working even when those two are down.

Acceptable use

Please do not attempt to break, overload, reverse-engineer or resell Underweather, use it to store anything unlawful, or use it to provide clinical advice to anyone else.

Our liability

To the extent the law allows, we are not liable for indirect or consequential loss, for lost data you did not back up, or for decisions made in reliance on what the app describes. Where liability cannot be excluded, it is limited to resupplying the service or paying the cost of doing so.

None of this excludes liability that cannot lawfully be excluded, including under the Australian Consumer Law.

Ending it

You can stop using Underweather at any time by cancelling your subscription and deleting the app. We may suspend access if these terms are seriously breached.

Governing law

Underweather is supplied from Australia. These terms are governed by Australian law, and nothing in them limits rights you have under the Australian Consumer Law or under the consumer law of the country you are in.
